Welcome to Scaletra! These Terms and Conditions ("Terms") govern your use of Scaletra, which
provides websites, online tools, mobile apps, mapping services for adventure planning and
radio-controlled activities, and related services (e.g., "customer support, APIs, or future
features") (collectively, the "Services"). By accessing or using the Services, you agree to
these Terms and our Privacy Policy. If you
do not agree to these Terms, please do not use the
Services.
1. Acceptance of Terms
By using the Services, you confirm that:
- You must be 13+ to use Scaletra (or the applicable legal age in your jurisdiction to use the
Services). If you are under 13, you are not permitted to use the Services, and any account
created will be terminated upon discovery. We may restrict access or delete any associated
data.
- If you are under the legal age of majority in your jurisdiction, your parent or legal
guardian has reviewed and agreed to these Terms on your behalf. Contact support@scaletra.com to provide consent for users
under the applicable age.
- You have the authority to bind any entity you represent (e.g., a company or organization) to
these Terms.
- By using the app, you grant Scaletra permission to access your device’s GPS, camera, and
storage as needed to provide mapping, tracking, and content-sharing features. See our
Privacy Policy for details.
- You agree to receive push notifications related to your account or activities. Opt out
anytime in app settings.
2. Definitions
- Services: The Scaletra websites, online tools, mobile apps, mapping
services with real-time GPS tracking for adventure planning and radio-controlled activities,
and related services.
- Content: Any information, data, text, images, videos, or other materials
you upload, post, or share through the Services.
- User Data: Information provided during registration or while using the
Services, such as name, email address, and location data.
3. Registration and Accounts
To use the Services, you must create an account. You agree to:
- Provide accurate, current, and complete registration information which is part of your User
Data.
- Maintain and update your User Data promptly.
- Keep your login credentials secure and notify Scaletra immediately of any unauthorized
access.
- Use only one personal account (account sharing is prohibited), unless expressly authorized
by Scaletra for organizational use.
- We recommend using strong, unique passwords to protect your account.
- Scaletra reserves the right to suspend or terminate accounts that provide inaccurate User
Data, have multiple accounts, or violate these Terms.
4. Content and Ownership
4.1 Your Content
You retain ownership of any Content you upload, post, or share through the Services. By
submitting your Content, you grant Scaletra a non-exclusive, worldwide, royalty-free,
transferable, and sublicensable license to use, reproduce, modify, adapt, distribute, and
display your Content solely for the purposes of operating, promoting, and improving the
Services. For example, Scaletra may adapt your route maps to improve display functionality or
feature your public adventure photos in promotional materials with credit.
This license allows Scaletra to:
- Host, store, and technically process your Content to provide the Services.
- Use your Content for promotional or marketing purposes (e.g., showcasing user-generated
routes or adventures).
- Make your Content available to other users in accordance with your privacy settings (e.g.,
public, private, or shared with select users).
Scaletra will not use your Content for unrelated commercial purposes without your
explicit
consent. We may credit you for public Content used in promotions unless you request otherwise.
You can delete your Content at any time, and Scaletra will stop using it for future operations,
except where necessary for legal compliance, safety, or backup purposes.
Scaletra will not sell your Content or use it for purposes unrelated to the Services without your
prior written consent.
4.2 Privacy Settings
The Services allow you to control who can access your Content by marking it as:
- Everyone (Public): Visible to all users and non-users of the Services.
- No-one (Private): Accessible only to you. Private Content remains accessible to Scaletra
solely for service provision.
- Followers only (Shared): Available to specific users or groups.
You are responsible for selecting the appropriate privacy settings for your Content. If you mark
Content as public or shared, you understand that it may be copied, shared, or used by others,
and Scaletra is not responsible for how third parties use your Content.
4.3 Prohibited Content
You agree not to upload, post, or share any Content that:
- Violates any law, regulation, or third-party rights (e.g., intellectual property, privacy,
or data protection rights).
- Is harmful, abusive, defamatory, harassing, or discriminatory.
- Contains malware, viruses, or other harmful software.
- Promotes illegal activities (e.g., such as trespassing or unauthorized use of
radio-controlled vehicles), violence, or hate speech.
- Is false, misleading, or intended to deceive others.
- Any other activity Scaletra reasonably determines to be inconsistent with the intended use
of the Services.
Scaletra doesn’t routinely screen or monitor Content but reserves the right to
review, remove, or
disable access to any Content that violates these Terms or is otherwise objectionable (e.g.,
harmful, misleading, against community standards, specific actions such as content promoting
unsafe radio-controlled vehicle stunts, content that Scaletra deems, in its sole discretion, to
be unsafe, offensive, or detrimental to the community). However, Scaletra does not routinely
monitor all Content and is not responsible for the accuracy, quality, or legality of
user-generated Content.
4.4 Responsibility for Your Content
You are solely responsible for all Content you upload, post, share, or otherwise make available
through the Services, including its legality, accuracy, and consequences. By submitting Content,
you represent and warrant that:
- You own or have the necessary rights, licenses, and permissions to share it, and it doesn’t
infringe on any third-party rights (e.g., copyright, privacy, or publicity).
- You’ll cover any royalties, fees, or liabilities arising from your Content.
We don’t endorse or guarantee the accuracy, reliability, or quality of user Content,
and we’re
not liable for:
- Errors, omissions, or damages resulting from your Content or others’ use of it.
- Exposure to offensive, indecent, or inaccurate Content posted by users.
Your Content is considered non-confidential and non-proprietary (except as protected
by our
Privacy Policy and your privacy settings),
and your relationship with Scaletra isn’t fiduciary
or special. You bear all risks of relying on Content available through the Services. If you
encounter violating Content, report it to support@scaletra.com, we aim to review reports
within 3 business days. For communications sent via your device, you’re responsible for any
associated charges and confirm you have the right to contact your recipients through the
Services.
5. User Conduct
You agree to:
- Use the Services lawfully and ethically.
- Respect the rights and privacy of other users.
- Not engage in hacking, spamming, or distributing harmful software.
- Not impersonate others or misrepresent your affiliation with any person or entity.
- Not to claim ownership of others’ radio-controlled vehicles without their permission.
- Not use automated tools to scrape, employ bots, or deliberately overload the Services.
- Not engage in unsafe or illegal activities (e.g., trespassing on private land based on
shared routes).
6. Proprietary Rights
- Scaletra (or its licensors) owns all intellectual property related to the Services except
for the content you create and submit. This includes software, code, algorithms used to
provide the Services, logos, trademarks, branding, maps, data, and other materials created
by Scaletra.
- Scaletra processes, stores, and transfers User Data as part of providing the Services.
- You cannot rent, sell, copy, modify, reverse-engineer, create derivative works based on the
Services, or distribute any part of the Services without Scaletra’s written permission.
- Scaletra gives you a limited, personal, and revocable license to use the Services. However,
you must not attempt to access the source code, create derivative works, or transfer your
rights in any way, unless the law expressly allows it. Also, you may only use the Services
through the official interfaces provided by Scaletra.
7. Third-Party Services
The Services may connect with third-party platforms (e.g., Mapbox, Google, Facebook). When you
use these integrations, your User Data may be shared with those platforms, subject to their own
terms and privacy policies, which Scaletra does not control. Scaletra is not responsible for the
content, actions, availability, disruptions, failures or policies of these third parties, nor
does it endorse them.
Scaletra is not liable for any content, information, advertisements, products, or materials
provided by these external platforms. If a third-party site or resource becomes unavailable,
Scaletra has no obligation to ensure access.
Some features of the Services may require you to purchase third-party equipment or materials
(e.g., GPS systems). While Scaletra may suggest certain suppliers, it is not responsible for
your decision to acquire or use these items. Scaletra does not guarantee that such equipment or
materials will work seamlessly or be compatible with the Services or be free of errors and
failures. Unless explicitly stated in these Terms, Scaletra offers no warranties for third-party
products or services.
You acknowledge that third-party services may involve additional fees or terms not controlled by
Scaletra, and Scaletra is not liable for their security practices or data handling.
You agree that Scaletra is not liable for any loss or damage resulting from your interactions
with third-party service providers or advertisers accessed through the Services.
8. Privacy and Data Protection
Your privacy is important to us. We comply with applicable data protection laws in your
jurisdiction. By using the Services, you agree to Privacy Policy regarding the collection,
use, and sharing of your User Data.
9. Payment, Refunds, and Cancellations
The app is free now. Future paid features (e.g., premium maps) will have clear pricing in-app.
Cancel subscriptions anytime in your account settings.
10. Your Feedback
We welcome your comments, suggestions, and feedback about the Services ("Feedback"). By
submitting Feedback, you agree that:
- Scaletra may use, modify, and incorporate your Feedback into its Services, products, or
features without any obligation to compensate you.
- Scaletra may share your Feedback with third parties for the purpose of improving the
Services.
- You grant Scaletra a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable
license to use, reproduce, modify, distribute, and publicly display your Feedback for any
purpose related to the Services.
Please note that Feedback you provide is voluntary, and Scaletra is under no
obligation to use or
implement it. If you do not wish to grant these rights, please do not submit Feedback.
We value your input and will always strive to use your Feedback responsibly to improve the
Services for all users.
11. Disclaimers and Limitation of Liability
The Services are provided "as is", without warranties of any kind. Scaletra does
not guarantee:
- The Services will be error-free or uninterrupted.
- The accuracy or reliability of Content shared by users.
- That the Services will meet your specific needs.
To the fullest extent permitted by law, Scaletra and its affiliates, officers, employees, and
partners shall not be liable for:
- Any direct, indirect, or consequential damages arising from your use of the
Services, including potential property damage or injury from radio-controlled activities.
- Any injuries, accidents, or losses resulting from your reliance on Content
(e.g., navigation errors in mapped routes), improper equipment use, deviation from
recommended safety practices, equipment failure, user inexperience, or environmental hazards
(e.g., landslides, wildlife).
- Any data loss or unauthorized access to your account.
- Any issues caused by events beyond our control (e.g., weather conditions,
natural disasters, cyberattacks, government actions).
Scaletra’s app is 'as is.' We’re not liable for crashes, bad user routes, or
injuries from
activities. To the extent permitted by applicable law, Scaletra’s total liability for any claim
arising from the Services shall not exceed the amount of USD $50 or the fees paid by you in the
past 12 months.
12. Indemnification
You agree to indemnify and hold Scaletra and its subsidiaries, affiliates, officers, agents,
representatives, employees, partners, and licensors harmless from any claims, damages, or losses
including attorneys’ fees made by any third party due to or arising from:
- Your use of the Services.
- Your Content or conduct.
- Your radio-controlled activities (including, but not limited to, radio-controlled activities
in connection with any contests, races, or other events which Scaletra
sponsors, organizes, participates in, or whose Services are used in connection with).
- Your violation of these Terms, your violation of any data protection or privacy laws, your
violation of any rights or another person or entity, or applicable laws.
Your rights with respect to Scaletra are not modified by the foregoing
indemnification if the
laws of your country of residence, applicable as a result of your use of our Services, do not
permit it.
13. Account Termination and Data Retention
Scaletra may suspend or terminate your account for:
- Violations of these Terms.
- Requests by law enforcement or regulatory authorities.
- Extended inactivity or non-payment (if applicable).
- Discontinuation of the Services.
Upon termination:
- Your access to the Services will be revoked, and your content will be deleted permanently
after 30 days, except as required by law. Data may be retained beyond 30 days if required
for legal compliance (e.g., tax records or court orders) or to protect Scaletra’s rights
(e.g., in disputes).
- After account deletion, anonymized data may be retained only for service improvement, not
tied to your identity.
You may terminate your account at any time by following the instructions in your
account
settings. Upon voluntary termination, your data will be handled as outlined above. If your
account is terminated by Scaletra, you may contact support@scaletra.com within 14 days to request a
review, unless the termination is due to illegal activity.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative
Region. Any disputes shall be resolved in the courts of Hong Kong.
If you reside outside Hong Kong, you may have additional rights under your local laws (e.g., EU
data protection rights), which these Terms do not waive unless permitted by law.
Scaletra makes no representation that the Content or the Services are appropriate or available
for use in other locations. Access to or use of the Content or the Services from territories
where such access or use is illegal is prohibited. Those who choose to access the Services from
locations outside of Hong Kong Special Administration Region do so on their own initiative and
are responsible for compliance with applicable local laws.
15. General
These Terms are the full agreement between you and Scaletra regarding your use of the Services.
- Using the Services does not create a partnership, employment, or agency relationship between
you and Scaletra.
- If Scaletra doesn’t enforce a rule or right, it does not mean we’ve waived it.
- If a court finds any part of these Terms invalid, the rest still applies as intended.
- You cannot transfer your account or responsibilities under these Terms without Scaletra’s
written approval.
- Scaletra can transfer its rights or hire third parties to help provide the Services.
- Scaletra can notify you via email, mail, or through posts on the Services, including updates
related to User Data. These are all considered valid notices.
- A printed copy of these Terms or any electronic notice is legally valid in court.
- Section titles are primarily for convenience.
- Any rights not specifically granted to you are reserved by Scaletra.
16. Safety
Adventure’s on you, use Scaletra safely. We don’t check user routes for risks. Follow laws, check
conditions, and use proper gear. You’re responsible for any injuries or damage.
Here’s what you need to know:
- Assumption of Risk: You participate in physical activities (e.g., operating
radio-controlled vehicles, hiking, or adventuring in remote areas) at your own risk.
Scaletra is not responsible for any injuries, property damage, or losses that may occur
during these activities, whether caused by environmental conditions, equipment failure, user
error, or other factors.
- User-Shared Content: Routes, plans, and other Content shared by users are
not verified by Scaletra for safety, accuracy, or legality. Before following any
user-generated route or plan, confirm it’s safe and permissible for your intended use, and
check local conditions (e.g., weather, terrain, or access restrictions).
- Compliance with Laws and Guidelines: Always follow applicable local laws,
regulations, and safety guidelines when using the Services. For example, adhere to state
park rules or property boundaries to avoid trespassing. Scaletra does not endorse or assume
liability for activities that violate these rules.
- Equipment Responsibility: If you use third-party equipment (e.g., GPS
devices, radio-controlled vehicles, or batteries) with the Services, you’re responsible for
ensuring it’s safe, compatible, and properly maintained. Scaletra does not guarantee that
such equipment will function flawlessly or integrate seamlessly with the Services, and we’re
not liable for issues arising from equipment failures or defects.
- Safety Tips: We encourage you to take precautions, such as:
- Checking weather and environmental conditions before starting any activity.
- Using appropriate safety gear (e.g., helmets, protective clothing) where applicable.
- Avoiding risky or unfamiliar areas unless properly prepared.
- Letting someone know your plans when venturing into remote locations.
- No Duty to Monitor: While we care about your well-being, Scaletra does not
actively monitor or oversee the safety of activities conducted using the Services. It’s up
to you to assess risks and make informed decisions.
By using the Services, you acknowledge that adventure inherently involves risks, and
you agree to
take full responsibility for your safety and the safety of others involved in your activities.
17. Changes to These Terms
Scaletra reserves the right to update these Terms at any time. We will notify you of significant
changes via email or through the Services, including changes related to User Data. Significant
changes include those affecting your rights, fees, or data usage. By continuing to use the
Services after changes are made, you agree to the updated Terms.
